CC&R Amendment – From the Board President – includes Communication from NSCA Legal Counsel

Many Niguel Shores homeowners have let us know they want more information about the CC&R amendment that is on our ballot. They want to know if it has been reviewed by our attorneys and what it means to the governance of our Association. In response to those concerns, the below link is a communication to the community from our corporate counsel, Fiore, Racobs and Powers,  explaining why they have recommended amending the CC&RS and what the future effect of the amendment will be. Please note that this amendment does not expand the power of the Board of Directors or the Association in anyway. If you have further questions, our long time attorney, Dick Fiore, along with members of the current Board of Directors and past Directors will be at the ClubHouse this coming Saturday, April 14, at 10 AM to discuss this issue with homeowners. E-mail Blast to All Homeowners dated Monday, April 16, 2012:

Last Saturday, April 14th, a homeowner forum was held at the Community Center to discuss the proposed CC&R amendment which is included on the election ballot for the May 15, 2012 Annual Meeting.  We had approximately 35 people in attendance and we had an excellent meeting – but we had hoped for a larger attendance. The Association legal counsel was in attendance at the meeting and prepared the attached letter to explain  the purpose and effect of the proposed amendment to the CC&Rs.  Please take a few minutes to read the attachment before you vote.   The ballots were mailed last Friday, so watch your mail and be sure to complete your ballot and send it as directed.
