PRIVACY FENCES AND VIEW FENCES

Niguel Shores was constructed as a terraced community to provide ocean views to several lots. Lots with a view will have two types of fences installed by the Developer—privacy fences and view fences.

■ A privacy fence is six feet in height and runs along or parallel to a side property line.

■ A view fence is the lower height fence located in the rear yard portion of the lot.

The Developer created a specific architectural rule that clarifies the intent of these two fence types.

■ The location of a privacy fence cannot change because this fence line sets the boundaries for rear house expansions, both for the property the fence is located on and the property directly adjacent to the fence.

■ The height of a view fence cannot exceed its current height because the purpose of this fence is to provide views. No above ground permanent improvement placed along a view fence can exceed the height of the view fence.

Items such as chairs, tables, and pools/spas placed within a view fence area are not subject to privacy protection.

When it comes to protecting privacy and views, the Developer’s recorded CC&Rs specifically state that views will be protected over privacy.
